Terms of Service

Effective July 7, 2026

These terms apply to your use of dimelamedia.com and to photography and creative services provided by Lloyd Duimstra, doing business as Dime LA Media ("we," "us"), in Sioux Falls, South Dakota. Booked services are additionally governed by a signed service agreement; if these terms and a signed agreement conflict, the signed agreement controls.

Booking and Payment

• A date or session is reserved only once a signed agreement and the required retainer (typically 50% of the total) are both received.
• Retainers are non-refundable except where your signed agreement says otherwise, because reserving your date means declining other work.
• The remaining balance is due by the date stated in your agreement or invoice. Late or missing payment may delay delivery of images.
• Monthly plans (such as social media management and website maintenance) run for the minimum term stated in the plan. Early exit requires payment of the remaining term unless your agreement says otherwise.
• Payment is by card through a Square invoice or payment link. Effective August 20, 2026, checks are not accepted, personal or business. A mailed check does not hold a date and will not be deposited. Cash and peer-to-peer apps (Venmo, Zelle, Cash App) are not accepted unless arranged in writing in advance.

Sales Tax

• Every price shown on this site, quoted by email, or stated in a proposal is a pre-tax price. Sales tax is not included in any advertised figure.
• South Dakota state sales tax, plus any applicable municipal sales tax for the jurisdiction where the service is delivered, is calculated and added to your invoice at the current rate in effect on the invoice date.
• Tax is applied to the full taxable amount, including retainers, add-ons, travel charges, and products, unless an exemption applies.
• If you hold a valid South Dakota exemption certificate, provide it before the invoice is issued and no tax will be charged on qualifying items.

Rescheduling and Cancellation

Reschedule and cancellation rights depend on the service and are stated in your agreement. Weather reschedules for outdoor sessions are accommodated where possible. If we must cancel for reasons within our control, amounts paid for work not performed will be refunded.

Image Rights and Usage

• Lloyd Duimstra, doing business as Dime LA Media, retains copyright in all photographs and video we create.
• Clients receive a personal, non-commercial license to download, print, and share their delivered images unless a commercial license is included in the package.
• We may use images from your session in our portfolio, website, and social media unless your agreement or release says otherwise. If you prefer your images not be used publicly, tell us in writing before your session.
• Delivered images may not be resold or licensed to third parties without written permission.

Deliverables and Timelines

Delivery timelines and image counts are stated on the relevant service page and in your agreement. Editing style is at the photographer's professional discretion consistent with the portfolio shown on this site. RAW files are not delivered.

All content on dimelamedia.com, including photographs, text, and design, is owned by Lloyd Duimstra, doing business as Dime LA Media, or used with permission, and may not be copied, scraped, or reproduced without written consent.

Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from services or this website is limited to the amount you paid for the service at issue. We are not liable for indirect or consequential damages. In the unlikely event of equipment failure, media corruption, or other circumstances beyond our control, liability is limited to a refund of amounts paid for the affected deliverables.

Governing Law

These terms are governed by the laws of the State of South Dakota. Any dispute will be resolved in the state or federal courts located in Minnehaha County, South Dakota.

Changes

We may update these terms from time to time. The effective date above reflects the latest revision.
